Oahu STR Zoning: Where Short-Term Rentals Are Actually Legal

One of the most common questions from property owners and investors on Oahu is: Can I legally rent my property as a short-term rental? The answer depends almost entirely on zoning. Honolulu’s zoning laws strictly limit where STRs can operate, and violating these rules can result in fines of up to $10,000 per day.

How Zoning Controls STR Eligibility on Oahu

The City and County of Honolulu uses zoning designations to determine what types of activities are permitted on each parcel of land. For short-term rentals, the key principle is simple: STRs are only permitted in resort-zoned areas and a few specific apartment-zoned areas.

This means the vast majority of residential neighborhoods on Oahu—including single-family homes in places like Mililani, Kailua, Kaneohe, and Ewa Beach—are off-limits for vacation rentals under 30 days.

Resort-Zoned Areas: Where STRs Are Permitted

The primary areas where short-term rentals are legally allowed on Oahu are resort-zoned districts. These include:

  • Waikiki – The largest concentration of legal STRs on Oahu, with thousands of registered vacation rental units in condos and hotels.
  • Ko Olina – A master-planned resort community on Oahu’s west side with resort-zoned condo properties like the Beach Villas at Ko Olina.
  • Turtle Bay (Kawela Bay) – The resort area on the North Shore where STRs are permitted within the resort-zoned parcels.

Properties in these resort zones can operate STRs without needing a Nonconforming Use Certificate (NUC), but they must register with the Department of Planning and Permitting (DPP) and pay the applicable registration fees.

Specific Apartment-Zoned Properties

In addition to resort zones, a small number of properties in apartment-zoned areas (A-1 and A-2 precincts) are also permitted to operate STRs under Ordinance 22-7 (Bill 41). These include select buildings in and around Waikiki such as:

  • Waikiki Banyan
  • Waikiki Sunset
  • Palms at Waikiki
  • Royal Garden at Waikiki
  • Ala Moana Hotel
  • Executive Centre

The specific eligible properties and areas are mapped in Ordinance 25-52, which updated the original Bill 41 provisions. If your property is not on this list or in a resort zone, it is not eligible for STR use unless you hold a valid NUC.

Nonconforming Use Certificates (NUCs)

Some properties outside of resort zones are grandfathered in under Nonconforming Use Certificates. These NUCs were issued to properties that were legally operating as vacation rentals before the City stopped issuing new ones in September 1990.

Where STRs Are NOT Allowed

Short-term rentals are not permitted in:

  • Single-family residential zones (R-3.5, R-5, R-7.5, R-10, R-20)
  • Agricultural zones (AG-1, AG-2)
  • Most apartment zones (unless specifically listed in Ordinance 25-52)
  • Country and rural zones

Operating an illegal STR in these areas can result in daily fines, cease-and-desist orders, and enforcement action from the DPP. The City has been increasing enforcement efforts and uses platforms like Airbnb and Vrbo to identify non-compliant listings.

The 30-Day vs. 90-Day Minimum Rental Period

Ordinance 22-7 originally attempted to increase the minimum rental period from 30 to 90 days across Oahu. However, a federal court ruled that this could not be applied retroactively to properties that were already operating under the 30-day rule before 2022.

As of September 2025, new non-NUC residential rentals must have a minimum term of 90 consecutive days. Properties in resort zones can still rent for less than 30 days. The DPP continues to enforce the 30-day minimum for all non-resort, non-NUC properties.

How to Check Your Property’s Zoning

To determine whether your property is in an STR-eligible zone:

  1. Visit the Honolulu Land Information System (HiLIS) at the DPP website
  2. Enter your Tax Map Key (TMK) or address
  3. Review the zoning designation for your parcel
  4. Check the STR Compliance Map referenced in Ordinance 25-52

If you are unsure about your property’s eligibility, consult with a real estate professional or the DPP directly before listing on any platform.

What This Means for Buyers and Investors

If you are considering purchasing a property on Oahu specifically for short-term rental income, zoning should be the first thing you verify. A property in Waikiki or Ko Olina with resort zoning offers the clearest legal path to STR operations. Properties with active NUCs can also be valuable, but require careful due diligence during the purchase process.
