One of the most common questions we get from VA buyers on Oahu is: "Can my spouse (or someone else) be on the title if they're not a veteran?" The answer depends on who you want on title and whether they'll be on the loan.

This is an important distinction that affects your down payment, entitlement, and closing process.

Title vs. Loan: What's the Difference?

Before diving in, it's important to understand two separate concepts:

  • On the loan (mortgage): This person is financially responsible for repaying the loan. Their income, credit, and debts are all evaluated.
  • On the title (deed): This person has ownership interest in the property. They don't necessarily have to be on the loan.

You can have someone on the title who is not on the loan. However, the reverse gets more complicated with VA loans.

Scenario 1: Veteran + Spouse (Most Common)

Spouse on Both Title and Loan

This is the most straightforward scenario. Both spouses are on the mortgage and on the deed. The spouse's income helps with qualification, and their credit is reviewed. Full VA entitlement applies — $0 down payment.

Spouse on Title Only (Not on Loan)

The veteran is the only borrower on the loan, but the spouse is added to the title/deed. This is common when one spouse has credit issues. The VA allows this with no impact on entitlement or down payment.

In Hawaii, since it's a community property state-like jurisdiction for some purposes, lenders may still require the non-borrowing spouse to sign certain documents at closing.

Scenario 2: Veteran + Non-Spouse (Parent, Sibling, Partner)

Non-Spouse on Title Only

A non-spouse can be added to the title without being on the VA loan. However, this may affect the VA's guaranty calculation. The VA only guarantees the veteran's portion of the ownership, which could mean:

  • A down payment may be required on the non-veteran's portion
  • The full $0 down benefit may not apply to the entire loan amount

Non-Spouse as Co-Borrower on the Loan

If a non-veteran, non-spouse co-borrower is on both the loan and title, the VA only guarantees the veteran's half. This means:

  • The non-veteran's portion typically requires a down payment (usually 12.5% of their share)
  • Only the veteran's share gets the VA guaranty

Exception: If both borrowers are VA-eligible veterans, both can use their entitlement and the full loan can be covered with $0 down.

Scenario 3: Two Veterans Buying Together

If two eligible veterans buy a home together (whether married or not), they can both use their VA entitlement. This is called a joint VA loan. Both veterans' entitlements are combined, and the full purchase can be covered with $0 down.

This is a great option for veteran couples or two veterans who want to buy an investment property together (as long as one lives there as a primary residence).

Hawaii-Specific Considerations

Community Property

Hawaii is not a community property state — it follows equitable distribution rules. However, some lenders still evaluate both spouses' debts when underwriting a VA loan, even if only one spouse is on the loan. This can affect your debt-to-income ratio.

Trust and LLC Ownership

Some Hawaii buyers want to hold property in a living trust or LLC. VA loans can close into a trust under certain conditions, but there are specific requirements. Discuss this with your lender before closing.
